Terms of Service

These Terms govern your use of Evolve OS (the “Service”), operated by Evolve OS (“we”, “us”). By creating an account or using the Service you agree to these Terms. If you don’t agree, don’t use the Service.

1. The Service

Evolve OS is a subscription tool for Australian mortgage brokers offering AI-assisted file notes, a curated news feed, and social carousel generation. Features and limits may change over time.

2. Your account

You must provide accurate details, keep your password secure, and are responsible for all activity under your account. You must be authorised to use the Service for your business and be at least 18.

3. Subscription & billing

The Service is $69 per user per month (AUD), billed in advance through our payment processor, Stripe. Your subscription renews automatically each month until cancelled. You can cancel anytime; access continues until the end of the paid period. Fees are non-refundable except where required by the Australian Consumer Law. Monthly usage limits apply to protect fair use.

4. Acceptable use

Don’t misuse the Service: no unlawful content, no attempts to breach security or limits, no reselling or sharing your account, and no uploading of data you aren’t permitted to share. We may suspend accounts that breach these Terms.

5. AI-generated content

The Service uses AI to generate drafts. Outputs may be inaccurate, incomplete, or unsuitable. You are responsible for reviewing and editing all outputs before use, and for ensuring anything you publish or rely on meets your professional, licensing, and compliance obligations. Evolve OS does not provide financial, credit, or legal advice.

6. Your content & our platform

You retain ownership of the content you input and the outputs you generate. You grant us the limited licence needed to operate the Service (including sending content to our sub-processors to generate outputs). We own the Service, software, and branding.

7. Third-party services

The Service relies on third parties including OpenAI and Anthropic (AI processing), Stripe (payments), Supabase (data storage), Resend (email), and Vercel (hosting). Your use is also subject to their terms. See our Privacy Policy for how your data is handled.

8. Disclaimers & liability

The Service is provided “as is” without warranties, to the extent permitted by law. Nothing in these Terms excludes rights you have under the Australian Consumer Law. To the maximum extent permitted, our liability is limited to the amount you paid us in the 3 months before the claim, and we are not liable for indirect or consequential loss.

9. Termination

You may stop using the Service and cancel at any time. We may suspend or terminate accounts that breach these Terms or where required by law.

10. Changes

We may update these Terms; we’ll update the date above and, for material changes, notify you. Continued use means you accept the changes.

11. Governing law

These Terms are governed by the laws of New South Wales, Australia, and you submit to the courts of that state.
